The Basic Law of Germany mandates adherence to international legal frameworks, yet the government’s approach to the conflict in Gaza and the West Bank suggests a departure from these principles. While Berlin frequently condemns violations of international norms in other regions, it defaults to political cushioning when confronted with evidence of collective punishment and displacement in occupied territories. This inconsistency has fueled perceptions of a double standard, particularly among nations in the Global South, and risks eroding the very rules-based system Germany claims to uphold.

Central to this shift is a misapplication of Staatsräson—the raison d'état rooted in the duty to protect Jewish life. By interpreting this historical obligation as a license for blanket immunity, officials have effectively placed a foreign government above the reach of international accountability. Proposals to criminalize political speech questioning a state’s "right to exist" further illustrate this drift, threatening both constitutional protections and the integrity of free expression. True security, both for Jewish communities and the broader region, requires moving beyond unconditional support toward a policy of moral consistency. This necessitates an end to arms exports linked to illegal settlements and a reversal of the current blockade on EU-wide measures, such as targeted sanctions and the suspension of the EU-Israel Association Agreement. Upholding the rule of law demands that Germany confront the actions of its allies with the same rigor it applies to its adversaries.
