Right-wing activists are drafting an executive order designed to grant President Donald Trump unilateral authority to ban mail-in ballots and voting machines before the 2026 midterms. The proposal seeks to bypass constitutional mandates that vest election management solely within the jurisdiction of individual states and congressional oversight.

The initiative, reported by The Washington Post, relies on the premise of a declared national emergency to justify federal intervention. Florida attorney Peter Ticktin, a vocal proponent of the strategy, admitted that the Constitution provides no mechanism for presidential involvement in state-run elections. However, he argued that alleged foreign interference from nations like China creates an exigency that necessitates executive action.

While the White House’s formal level of involvement remains opaque, the administration has previously signaled interest in similar tactics, including efforts to investigate the 2020 election results. Intelligence reviews have repeatedly debunked claims of systemic foreign interference in past cycles, yet Trump continues to characterize voting technology and mail-in ballots as inherently fraudulent.

Opposition to the potential order is mounting from both legal watchdogs and Democratic lawmakers. Senator Mark Warner described the effort as a direct assault on democratic accountability, while Citizens for Responsibility and Ethics in Washington (CREW) dismissed the plan as unconstitutional. Critics, including Illinois Governor JB Pritzker and Representative Rosa De Lauro, have characterized the move as a calculated attempt to undermine the rule of law and secure electoral outcomes through executive fiat.
