Italian court challenge targets EU's new asylum pre-screening rules

An Egyptian national’s appeal against a rejected asylum claim in Italy has launched a constitutional challenge against the European Union’s migration pact. By contesting his detention during a fast-track process, the case threatens to unravel the legal framework that defines migrants as technically outside EU borders upon arrival.

Italian court challenge targets EU's new asylum pre-screening rules

The applicant, who arrived on Lampedusa in August, was funneled into an accelerated procedure reserved for nationals from countries with low asylum success rates, such as Egypt. His legal team reports that the process was fundamentally flawed, noting that the claimant could not even understand his translator during the assessment. Attorney Claudia Avenia argues that no European regulation can supersede Italy’s constitutional protections, setting the stage for a clash between national supreme principles and the bloc’s unified migration policy.

At the heart of the dispute is the 'legal fiction of non-entry' established by the new EU pact, which took effect in June. Under these rules, migrants are held in reception centers for health checks and identification, officially remaining outside the EU’s territory until clearance. Rights advocates previously warned that this pre-screening phase would result in de facto detention, stripping individuals of their freedom without formal entry. This case now forces Italian courts to determine whether such administrative containment violates the human rights standards enshrined in the national constitution.
